Terms of Service

These terms are an agreement between you and YunHe, an individual operator based in Hong Kong, who runs Smew AI at smew.ai ("Smew AI", "we", "us"). By using the site you accept them. If you don't, please don't use Smew AI.

The service

Smew AI makes short AI videos and images. You can use a trend template (add your photo and we make the video or photo in the style of a viral trend) or describe your own idea on the Create page and choose an AI model. Results are made by third-party AI models and can vary; a template's example shows the style, not a promise of an identical result.

We may add, change or remove templates, models and features at any time.

Accounts

You can start without signing up: we create a guest account in your browser so your uploads and purchases are kept. Signing in with email or Google keeps them across devices. You are responsible for what happens under your account and for keeping your sign-in details safe. You must be at least 16 years old, or the age of digital consent where you live if higher.

Credits, plans and payments

• Everything you make costs credits. The price is shown on the button before you spend anything.
• One-time packs add credits that never expire.
• Plans (weekly, monthly or yearly) are charged in advance and renew automatically until you cancel. Each period adds the plan's credits; yearly plans add them once a month. Plan credits last until the next batch arrives or the plan ends, and they are used before your pack credits.
• You can hold one plan at a time. A bigger plan starts at once and you pay the prorated difference; a smaller plan starts at your next renewal.
• First-period prices apply only to an account that has never subscribed.
• If a generation fails, its credits are returned automatically.
• Payments are processed by Stripe. We never see or store your card number.
• You can cancel any time in Profile; the plan stays active until the end of the period you paid for.
• Refunds follow our Refund policy.

Credits have no cash value and can't be transferred or sold.

What you may upload and make

You may only upload photos, videos and sounds that you own or have permission to use, and only photos of people who have agreed to it. You must not use Smew AI to create or attempt to create:

• sexual, nude or intimate content of any real person, or any non-consensual intimate imagery;
• any sexual content involving a minor, or content that sexualises minors in any way;
• content that impersonates a real person to deceive others, or puts a real person in a false and harmful light;
• content that harasses, threatens or promotes hatred or violence against anyone;
• content that infringes someone else's copyright, trademark or other rights;
• anything illegal where you live or in Hong Kong.

Typed prompts and photos are screened automatically. We may refuse a request, remove content and close accounts that break these rules, without refund of the credits used, and we report child sexual abuse material to the authorities.

Your content

You keep the rights you have in what you upload and in your results, to the extent the law allows. You give us a limited licence to store, process and send your uploads and prompts to our AI providers only to make your results and run the service. We don't use your photos to train AI models.

You are responsible for how you use your results, including getting any permission you need before you post them (for example for music in a trend, or for people who appear in them). Trend names, songs and original reels belong to their owners; we link to and credit original creators and are not affiliated with them.

Our service

The site, its design, templates and software belong to us. Don't copy, scrape or resell the service, try to get around credit charges or limits, or interfere with its security.

Availability and liability

Smew AI is provided "as is". We work to keep it running and accurate but don't guarantee that it is uninterrupted, error-free or that a result will meet your expectations. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing here limits rights you have under consumer law that can't be excluded.

Ending your use

You may stop using Smew AI and ask us to delete your account at any time by writing to support@smew.ai. We may suspend or close an account that breaks these terms.

Changes and law

We may update these terms; the date above shows the latest version, and continuing to use the service means you accept it. These terms are governed by the laws of the Hong Kong Special Administrative Region, and its courts have jurisdiction, unless your local consumer law says otherwise.
